What is a DMV Hold on your license?

Failure to deal with a traffic ticket in a timely manner will result in the court contacting the California Department of Motor Vehicles (DMV) in order to have your license suspended or a DMV Hold placed on it until you resolve your traffic ticket.

A DMV hold on your drivers license results in one or both of the following :-

  • The inability to renew your license
  • A suspension or revocation of your licensing privileges.
Traffic Ticket Due Date

When you are given a traffic ticket, you will see a court date is listed at the bottom of the traffic ticket. If you fail to take any action on this ticket and you do not appear in court by the due date on the bottom of your ticket, you will be charged with a Failure To Appear (VC 40509.5 holds).

Many people fail to appear in court because they are waiting on a letter from the Traffic Court. Unfortunately many times the court does not send a courtesy letter about your ticket and many people fail to appear in court by the due date listed at the bottom of the traffic ticket.

The consequences of Failure To Appear

When you fail to appear in court by the due date on your traffic ticket, the Court will contact the DMV and if applicable to the charge, a DMV hold may be placed on your driver’s license by the Department of Motor Vehicles, resulting in the inability to renew your license and/or a suspension or revocation of your license privileges to your California drivers license.

Oftentimes people have no idea there is a DMV hold on their license until they try to renew their license or renew their insurance and then they find out their license is suspended or cannot be renewed.

What is a DMV Abstract?

A DMV Abstract clears up FTAs or Holds on your license.

If you fail to appear in court for your traffic ticket the DMV will then most likely suspend your license for this Failure To Appear - FTA (VC 40509.5 holds or DMV hold) . The best way to remove this failure to appear off your license is to to buy a DMV abstract.

A DMV abstract is basically an email from the traffic court to the DMV informing the DMV that you are now taking care of your traffic ticket and consequently the DMV will remove the hold or Failure to Appear (FTA) on your suspended license allowing you to get your license back.

How to get a DMV Abstract

The DMV abstract must be purchased from the courthouse listed at the bottom of your traffic ticket. (The court location and address is marked on the bottom of your traffic ticket).  If you don't know the court location of your ticket, follow this link to  search the Los Angeles Superior court website (this link will open in a new tab in your browser).

You cannot buy a DMV abstract by phone or on the Internet; it must be done IN PERSON at the courthouse listed on your traffic ticket.

A DMV abstract costs $10 and it takes about 24 to 48 hours to clear up the failure to appear, (VC 40509.5 holds) DMV hold on your license.

The court will send the DMV Abstract electronically to the DMV

In Los Angeles County you do not have to personally take the DMV abstract to the DMV yourself, because the court sends it to the DMV for you electronically by email.

Failing to Appear Twice

Note:  if you have failed to appear two times on your traffic ticket, most courts will not allow you to buy a DMV abstract to clear up your suspended license. If you have failed to appear twice and the court will not allow you to buy a DMV abstract, then call us because we can sometimes help get you a DMV abstract immediately.

Note - if you have already seen a Judge and plead guilty or no contest, and you failed to pay your fine or do your community service by the due date, and the court says your traffic ticket is now a "matter set for compliance": This means the only way you can get a DMV abstract is to pay the fine that GC Services (a collection agency) is charging you. WE CANNOT HELP YOU get a DMV abstract if you have already seen a Judge and failed to pay the fine or do the community service by the due and your matter is set for compliance.
